2. Legal Disclaimer
Land Leaser serves merely as a platform to connect landowners and users. We do not guarantee any lease agreements or manage any transactions. Users are encouraged to conduct their due diligence and seek appropriate legal advice before entering into any lease agreements.
3. Arbitration Agreement
By using the Land Leaser app, you and Land Leaser agree to resolve any disputes, claims, or controversies that arise out of or relate to your use of the app or any actions taken in connection with it, through binding arbitration instead of going to court. This includes, but is not limited to:
– Any claims related to lease agreements made through the app
– Claims against landowners
– Claims against other users of the app
– Any disputes regarding the functionality, services, and operations of Land Leaser
4. Opting Out
If you do not wish to be bound by this arbitration agreement, you may opt-out by submitting a written notice to Land Leaser at customerservice@land-leaser.com within 30 days of your first use of the app. Failure to opt-out within this time frame will result in full acceptance of this agreement.
5. Arbitration Process
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in New York, unless you and Land Leaser agree otherwise. 6. Governing Law
This arbitration agreement shall be governed by the Federal Arbitration Act, as well as applicable state laws.
7. Severability
If any provision of this arbitration agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
8. Entire Agreement
This arbitration agreement constitutes the entire agreement between you and Land Leaser regarding the subject matter herein. It supersedes any prior agreements or understandings, whether written or oral.
9. Amendments
Land Leaser reserves the right to modify these terms at any time. Any changes will be effective upon posting in the app or through direct communication. Continued use of the app after such modifications will signify your acceptance of the revised terms.
10. Governing Law
These Terms of Use are governed by the laws of the country of residence, without regard to its conflict of law principles. Any disputes arising from these terms will be resolved in the appropriate courts of your country and place or residence .
